Terms and rental conditions
Effective 17 September 2026
What these cover
These terms cover two different things, and it matters which one you are doing.
Using this website. Reading the pages, sending the contact form, and using the availability module. These terms apply from the moment you use the site.
Booking one of our three homes. The Cape Coral Luxury Escape, the Cape Coral Adventure Package, and the Fort Myers Beach Condo. A booking is a separate agreement, and the rental sections below are its terms.
If you booked through a listing platform — Airbnb, Vrbo, Booking.com or similar — that platform’s cancellation and payment rules govern your reservation and they may differ from ours. Everything on this page about the property itself still applies: the house rules, the pool, the dock, the boat, damage, and what you agree to on arrival.
Real estate services are not covered here. Working with Stephanie DeLisle as a buyer’s agent happens under a separate written brokerage agreement between you and her brokerage. Nothing on this website creates that relationship, and nothing on this website is a substitute for it.
The agreement, and who it binds
The person who makes the booking is the primary guest. You must be at least 18 and you must be one of the people actually staying — we do not accept bookings made on behalf of a group the booker is not part of.
You are responsible for everyone in your party, including anyone who visits during your stay: their conduct, any damage they cause, and their compliance with these terms. Before you arrive, make sure everyone staying knows the rules that apply to them — particularly the ones about the pool, the dock and the boat, where a rule exists because somebody could be hurt.
This is a short-term vacation rental, not a tenancy. You are a transient occupant, you acquire no tenancy or residency rights in the property, and Florida law provides a procedure for the removal of a transient occupant who refuses to leave (§ 82.045, Florida Statutes). You may not assign this agreement, sublet the property, or list it for rent yourself.
Accepting a booking confirmation, or checking in, means you accept these terms on behalf of your whole party.
How a booking is made
Availability shown on this site is a live read of our property-management system, and it can change between the moment you look and the moment you book. A booking exists when you have completed it in that system and received its confirmation — not when you submit the contact form, and not when one of us replies to say a week looks open.
Payment is taken by OwnerRez on its own hosted checkout, under that provider’s terms. We do not take card details on this site.
We may decline a booking. If we do it before you have paid anything, nothing is owed either way; if we do it after, you get everything you paid us back. We will not decline for any reason prohibited by law — see Equal Housing Opportunity below, which is a commitment on both sides of this business.
What is due, and when
If a payment is not made by its due date we will contact you before doing anything else. If it stays unpaid, we may cancel the booking, and a cancellation for non-payment is treated the same as a cancellation by you on the day it happens — the refund section below decides what comes back.
Card fees charged by the payment provider are the provider’s, not ours. A returned or reversed payment may carry the bank’s own charge, which is passed through at cost and nothing more.
Rates, fees and taxes
Nightly rates vary by date and by length of stay, and all three properties are priced the same way. The rate you are shown for your dates is the rate for those dates — a real number, itemised in full, not a “from” price that changes at checkout.
Whatever your total is, you see all of it before you pay. Every fee that applies to your stay is itemised at checkout, and there is no charge added afterwards except the ones this agreement lets us add — damage, and the specific breaches listed under House rules.
The cleaning fee is a flat charge per stay, not per night, and it is the same whether you come for three nights or three weeks: $804 at the Cape Coral Luxury Escape, $517 at the Cape Coral Adventure Package, and $250 at the Fort Myers Beach Condo. It is quoted with your dates before you pay, and it is the only compulsory fee on top of the rate and the taxes.
There is no pet fee, because we do not accept pets at any of the three — see House rules below. Anything optional you add to a stay is priced and itemised in the same quote, before you pay, and never afterwards.
Florida sales tax and Lee County’s tourist development tax apply to short-term stays and are collected with your booking. Today that is 6.5% sales tax (including Lee County’s surtax) and 5% tourist development tax, both charged on the rent plus the cleaning fee. Those rates are set by the state and the county rather than by us, and they change — so your booking confirmation, not this page, is the authority on what you were actually charged.
Cancellations, changes and refunds
Cancel within 24 hours of booking and you get a full refund — 100% of what you paid. That one is settled and it applies to every property.
Moving your dates instead of cancelling is usually possible and always subject to the new dates being free. A move to a higher-rate period costs the difference; a move to a lower-rate period does not create a credit. If the new dates are not available, it is a cancellation and the ladder above decides it.
If we have to cancel — because the property has become genuinely unusable, or for any other reason on our side — you choose: the same dates at another of our homes if one is free and comparable, or every dollar you have paid us back, including fees. We do not keep a processing fee on a cancellation that was ours.
Refunds go back to the card that paid, and take as long as the card network takes.
Travel insurance
We recommend it, and we do not sell it. Southwest Florida in hurricane season is exactly the trip travel insurance exists for, and most of the reasons a vacation gets cancelled — illness, a death in the family, a job, a cancelled flight, a storm that never reaches us but closes the airport — are reasons this agreement does not refund. A policy bought from an insurer, early, is the only thing that covers them.
Buy it from whoever you like. If you ask us for a recommendation you will get an honest one, and we earn nothing either way.
Hurricanes, red tide and other natural conditions
Atlantic hurricane season runs 1 June to 30 November. Hurricane Ian came ashore near Fort Myers Beach on 28 September 2022 and the region has been rebuilding since, so this is not a theoretical section and we would rather be plain about it than reassuring.
If a government body issues a mandatory evacuation order covering the property, or a mandatory evacuation of the area you would have to travel through to reach it, we refund the nights affected by the order. That is the trigger — an official order, not a forecast, and not a storm that changes course.
Red tide, blue-green algae, sargassum and water quality. These occur naturally on this coast, they come and go, and no one controls them. They are not grounds for a refund, a credit or a move. Before you travel you can check current conditions yourself with the Florida Fish and Wildlife Conservation Commission and the Florida Department of Health in Lee County — and if you ask us what the water is actually doing that week, you will get a straight answer rather than a brochure.
Fort Myers Beach specifically. The condo page carries a dated status note about conditions on Estero Island rather than a general reassurance, because the honest answer changes month to month. Write to us before you book and we will tell you what the building and the surrounding streets are actually like that week.
Arrival, departure and getting in
Arrival and departure. Check-in is from 4:00 pm at the Cape Coral Luxury Escape and from 3:00 pm at the other two. Check-out is by 10:00 am everywhere. Minimum stay is three nights at the two Cape Coral houses and thirty nights at the Fort Myers Beach Condo. These are read from the booking system, which is also what enforces them, so the checkout will not let you book outside them. Early check-in and late check-out are not published terms — ask, and the answer depends on the turnaround that day.
Access is by door code or lock box, sent to you before arrival. The code is yours alone for the length of your stay — do not pass it on, post it, or leave it written anywhere in or around the property. Tell us straight away if you think someone else has it.
You are welcome to be met and walked through the house instead of letting yourself in; ask when you book. These are our own three homes and one of us is usually nearby.
Before you leave: dishes done or in the dishwasher, trash bagged and in the bins, anything you moved put back, windows and doors locked, and the air conditioning left at the setting the house guide asks for. There is no daily housekeeping, and the clean between guests is ours — this list is not a cleaning job, it is the difference between a normal turnaround and a rushed one.
Staying past check-out without agreement holds up the next guests, and the charge for it will be in the fee schedule above rather than invented after the fact.
House rules
How many people may stay. The Cape Coral Luxury Escape sleeps fourteen. The Cape Coral Adventure Package sleeps ten, in five bedrooms with four bathrooms. The Fort Myers Beach Condo sleeps six. These are limits, not targets, and they include children. Everyone staying overnight must be named on the booking.
Daytime visitors are fine in reasonable numbers. What is not fine is a booking for ten that becomes a party for forty, and that is the line: no events, no parties, and no commercial use — no photo or film shoots, no classes, no sales events — without our written agreement first. These are houses in residential neighbourhoods where people live year-round.
Quiet hours run [[CLIENT — set the hours; Cape Coral and Fort Myers Beach both have noise ordinances, and matching them is the easy answer]]. Outdoor music and voices carry over water much further than they do over land, which is worth knowing at a canal-side house with a pool cage.
No smoking or vaping anywhere, and that includes the lanai, the pool cage, the garage, the dock and the boat. If the property comes back smelling of smoke, the cost of getting it out is yours.
Pets. None of the three properties accepts pets — no dogs, no cats, at any of them. That is set in the booking system and the checkout applies it. A service animal is not a pet: tell us when you book and we will make the arrangements, with no pet fee, because the law treats the two differently and so do we.
Parking is on the driveway and in the garage where the house guide says so, and never on a lawn or blocking a neighbour. Trailers, RVs and commercial vehicles need our agreement first. [[CLIENT — how many vehicles each property takes.]]
Trash goes in the bins provided, and the bins go to the curb the night before collection — the house guide says which night. Cape Coral fines the property, not the guest, for a bin left out.
Nothing illegal, and nothing dangerous. No firearms brought onto the property, no fireworks, no open flames or candles indoors, no charcoal or propane used anywhere but the grill in the place the grill lives, and no drones flown over neighbouring property. Do not disable, cover or remove a smoke alarm, a carbon-monoxide alarm, a pool alarm or a door chime, ever — if one is chirping, tell us and we will change the battery.
We can end a stay for a serious breach of this section — occupancy well over the limit, an unauthorised event, a disabled safety device, or conduct that puts someone at risk. That is a last resort, we will talk to you first wherever there is time to, and it does not come with a refund.
What we provide, and what you bring
The homes are fully furnished and equipped for the number of people they sleep: beds made, linens and towels, a full kitchen, and laundry in the property. There is no daily housekeeping and no mid-stay linen change on a stay of ordinary length; ask us if you are staying a month.
At the Cape Coral Adventure Package the owners leave a starter kit — toilet paper, paper towels, soap, dishwashing detergent and laundry detergent — so the first day does not start with a shopping trip. It is a starter kit and not a fortnight’s supply. At the other two properties, assume consumables are yours to buy.
Air conditioning. Set it in the range the house guide asks for and keep the windows and doors closed while it is running. A system run far below its range in Florida humidity freezes up, and then it is not cooling anything for anybody — if that happens because the setting was ignored, the service call is on the booking.
Internet and television are provided and are not guaranteed. Both come from third-party providers we do not control, and an outage is not grounds for a refund. Tell us and we will chase the provider the same as we would in our own house.
A locked closet or cupboard is locked because it is the owners’ and is not part of what you booked. Please leave those alone.
The pool and the spa
The Cape Coral Luxury Escape has a heated pool and a hot tub. The Cape Coral Adventure Package has a screened in-ground pool with a spa attached to it. Water and children are the part of this agreement that most needs to be explicit, so it is set out plainly rather than buried.
There is no lifeguard, and there is no substitute for an adult watching. A child in or near the water must be supervised by a responsible adult at all times — not from indoors, not from a phone, in the pool area and paying attention. Drowning is silent and it is fast.
No diving anywhere. No running on the deck. No glass in the pool area. Nobody swims alone, and nobody swims after drinking. Keep the gate, the cage door and the house doors to the pool closed and latched, and if a pool alarm or a safety latch is not working, stop using the pool and tell us immediately.
Florida regulates residential pool safety by statute (chapter 515, Florida Statutes). The safety features on these properties are there because the law requires them and because they work. Disabling one is a serious breach of this agreement and is the clearest example of a reason we would end a stay.
Using the pool and the spa is at your own risk. You accept that risk for yourself and for everyone in your party, and neither Sunshine Endeavors nor the owners are liable for injury or death arising from the use of the pool or the spa, except to the extent caused by our own negligence — which the law does not let us disclaim and which we are not trying to.
A spa is not for everyone. Not for children unsupervised, not after drinking, and if you are pregnant or being treated for a heart condition or blood pressure, ask your doctor rather than us. Do not sit on a spa cover, and put it back when you are done.
Heat, honestly. Where a pool is heated, a pool heater lifts the water some degrees above the air over a day or so; it is not a boiler and a cold snap will beat it. We do not claim that the Adventure Package’s pool or spa is heated — nothing we have been told says either is. A pool that is not as warm as you hoped is not a refundable fault.
A pool technician services these pools weekly and needs to get to the equipment, which at the screened properties means through the cage door. Please do not lock it.
The dock, the boat and the boat lift
The Cape Coral Luxury Escape and the Cape Coral Adventure Package each have canal frontage with a private dock. The Adventure Package includes a 2020 Sweetwater 2286 Tritoon on a 10,000 lb lift, which the owners confirm is part of what you are renting. That makes this the most consequential section in the document and it is written to be read, not skimmed.
Who may operate the boat. Only an adult of 18 or over, named to us before the stay. Anyone born on or after 1 January 1988 who operates a vessel of 10 horsepower or more in Florida must hold a Boating Safety Education Identification Card and carry photo identification with it — that is state law, not a house rule, and we will ask to see the card. Nobody operates the boat after drinking. Nobody operates it who has not been shown how, by us, in person.
Life jackets. There is a US Coast Guard-approved wearable life jacket aboard for every person on the boat, and a throwable device as well. A child under six must wear a life jacket at all times while the boat is under way — Florida law, for any vessel under 26 feet. Count the jackets before you leave the dock and count the people; if the numbers do not match, do not leave the dock.
Do not exceed the capacity on the boat’s plate. No towing anyone — no tubing, no skiing, no wakeboarding. Stay inside the water the house guide describes and inside daylight. Watch for manatees and obey every posted speed and no-wake zone; this is a slow-speed coast and the fines are real.
Fuel is yours for the fuel you use, and the boat comes back the way it went out — same fuel level, rinsed, nothing left aboard. Damage to the boat, the motor, the propeller or the lift is on the booking, and running aground is damage. If the weather turns, come in; there is no trip worth the alternative and nothing on the schedule that cannot move.
The boat lift is operated by us or by an adult we have shown how to use it, and by nobody else. Nobody stands or sits on a boat while the lift is moving, and nobody swims near it.
Bringing your own boat. Ask first. Whether a dock will take it depends on the boat, and whether your canal route reaches open water depends on fixed bridge clearance, which we will not guess at for you — ask us and we will get you the clearance for that specific canal.
Fishing needs a Florida licence unless you are exempt, and the size, season and bag limits are the state’s. That is between you and the Florida Fish and Wildlife Conservation Commission, and it is easy to check before you go.
At the Fort Myers Beach Condo, the building has covered boat slips below it. We have not been told whether a guest may use one, so nothing on this site says you can — if a slip matters to your trip, ask before you book rather than after you arrive.
Using the dock, the lift and the boat is at your own risk, on the same terms as the pool above, and for everyone in your party.
Kayaks, paddleboards and bicycles
The Cape Coral Luxury Escape has kayaks and paddleboards. The Cape Coral Adventure Package has kayaks and bicycles. All of it is provided as a courtesy, in the condition it is in, and using any of it is at your own risk.
Wear the life jacket on the water — Florida requires a wearable device aboard for every person on a paddlecraft, and a child under six must wear one. An adult goes with anyone under 18. Wear the helmet on the bike, ride with traffic, and be visible: Cape Coral is a driving city and its drivers are not looking for you.
Tell us if something is damaged or unsafe instead of using it. Damage or loss caused by careless use is on the booking, and equipment gone missing is charged at replacement cost.
The condition of the home, and reporting a problem
Every property is inspected before you arrive. It is rented as it is — a real house that real people use, with the wear a real house has. The photographs on this site are of the actual properties and are current to the best of our knowledge.
Tell us within 24 hours of arrival about anything wrong: cleanliness, something broken, something missing, something that does not match what you booked. That window matters, because after a day it stops being possible to tell what was already there. We will put right what we can, as fast as we can get someone out, and we choose how — repair, replace, or a fair adjustment.
Things that are not a refundable fault, though we will still help: a utility outage, an internet or television outage, an appliance or pool-equipment failure we fix promptly, construction or traffic noise from a neighbouring property, insects and Florida wildlife getting inside, water temperature, and the weather. Southwest Florida has bugs and lizards, and no amount of pest control makes a screened lanai an indoor room.
If something genuinely cannot be fixed and it is bad enough to spoil the stay, we would rather move you to another of our homes or refund the nights affected than argue about it. What we will not do is refund a stay you completed and told us nothing about.
Damage
Accidents happen and we are not difficult about them. Tell us before you leave and an accident stays an accident. What turns it into a dispute is finding it after you have gone.
You are responsible for loss or damage caused by anyone in your party, deliberately or carelessly, beyond ordinary wear. That includes stains that will not come out, a broken screen on a pool cage, damage from an animal or a vehicle, and damage to the boat, the motor, the lift, the kayaks or the bikes. We charge what it actually costs to repair or replace, with the invoice, and nothing on top.
We do not hold your card details. Any charge for damage is raised through the booking provider, with the reason and the evidence, and you will hear it from us first.
Our access to the property
We will not walk in on you. We do need to get in sometimes: for pool service on its weekly day, for a repair you have asked for, for a scheduled inspection or lawn service, and in an emergency. Except in an emergency you will get reasonable notice, and someone will knock.
There is no camera or recording device inside any of these properties. Where a property has an exterior camera or a video doorbell it is disclosed in the listing and the house guide, it points at an entrance or a driveway, and it is never aimed at the pool area, the dock or any indoor space.
Your belongings
Bring what you like; it is your risk. We are not responsible for personal property lost, damaged or stolen at the property, and your own travel or homeowner’s insurance is what covers that.
If you leave something behind, tell us and we will look. We will hold what we find for a reasonable time and post it to you at cost — we do not charge a handling fee for returning your own property. What is unclaimed after that may be donated or disposed of.
Real estate notices
Real estate services are provided by Stephanie DeLisle, licensed Florida REALTOR®, license no. 258024795, Experience Real Estate Group, LLC. Equal Housing Opportunity.
Nothing on this website is an offer to buy or sell property, a legal opinion, tax advice, or financial advice. Nothing on this website is a projection of what a property will be worth or what it will earn as a rental — we do not publish those figures, and any number you are given about a specific property will come with its source and its date.
Property information taken from third-party sources, including the MLS, is believed accurate but is not guaranteed. Verify anything you are relying on — square footage, flood zone, permit history, bridge clearance, HOA rules, and whether short-term rental is allowed at that address — independently and before you close.
The site itself
The photographs on this site are of the actual homes. Where a photograph has not been supplied yet, you will see a labeled placeholder rather than a stand-in image of somewhere else — we do not use stock photography of other properties. Descriptions are written to be accurate; if you find something on this site that is wrong, tell us and we will fix it.
The words, photographs, and the Sunshine Endeavors logo belong to Sunshine Endeavors LLC. Links to other websites are not endorsements of them.
Limitation of liability
This section limits what we owe you if something goes wrong. It is written in plain words on purpose: a limitation you cannot read is not fair warning, and this is the part of an agreement that most often hides in the longest sentence on the page.
The properties are provided as they are. Beyond what this agreement says and what the law requires of us, we make no warranty about a property, its fitness for a particular purpose, or its suitability for anyone in your party.
Where we are liable, our liability for any claim arising out of a booking is limited to the total amount you paid us for that booking. We are not liable for indirect or consequential loss — travel costs, a missed event, time off work, or the cost of alternative accommodation beyond a refund of the nights you did not get.
We are not liable for events outside our reasonable control: weather and storms, evacuation orders, utility and internet failures, water quality, road and bridge closures, government action, or the acts of a third party we do not control.
Nothing in this agreement limits liability that the law does not allow us to limit — including for our own negligence causing personal injury or death, and for fraud. We are not attempting to, and a clause that tried would be worth nothing anyway.
Indemnity
If someone in your party, or a visitor of yours, causes injury to a person or damage to property during your stay, and a claim is made against us or the owners because of it, you will cover the reasonable cost of dealing with that claim. This does not apply where the claim was caused by our own negligence or breach of this agreement.
If something goes wrong between us
Start with us. Whoever answers your message is one of two people whose name is on the property, and almost everything is solvable in a phone call on the day it happens rather than a month later through a bank.
If it is not solvable that way, write to us and give us 30 days to respond before starting a chargeback or a formal claim. A chargeback raised before we have had a chance to answer costs both of us money and settles nothing — and if you have already been refunded, a chargeback for the same nights is a claim we will contest.
Write to expsunshine@gmail.com, or call (239) 233-4589 during office hours.
Governing law and where a dispute is heard
These terms are governed by the law of the State of Florida, without regard to its conflict-of-laws rules. The properties are in Lee County, Florida, and any claim that has to go to court goes to a state court in Lee County or to the federal court for the Middle District of Florida.
A claim arising out of a booking should be brought within one year of the last night of the stay.
General
These terms, together with your booking confirmation and the house guide for the property, are the whole agreement between us about your stay, and they replace anything said beforehand. Where a booking confirmation and this page disagree about your specific stay, the confirmation wins.
If any part of this agreement turns out to be unenforceable, the rest of it still stands. Not enforcing something once does not mean giving it up. Headings are there to help you find things and do not change what a section means. This agreement is between you and us, and nobody else can enforce it.
Booking online and accepting these terms electronically has the same effect as signing them on paper.
Changes, and reaching us
We update these terms when the business changes, and the date at the top moves with them. A booking is governed by the terms in force on the day it was confirmed. Sunshine Endeavors LLC, 1217 Cape Coral Pkwy E #359, Cape Coral, FL 33904. Questions: expsunshine@gmail.com or (239) 233-4589.
